Shipping & Returns

Shipping

Shipping on the national territory has a cost of €7 (seven), free shipping is granted for purchases for a total of €80 ore more.

Shipping outside the national territory has a variable cost depending on destination.

Shipping informations are summarized during purchase and in the order confirmation e-mail.

Deliveries will be made by:
BRT for the whole national and european territory.

With variable times according to the destinations. Please note that delivery times are only indicative and are calculated from the shipping day.

Hoop Sportswear does not assume liability for delays in customs clearance, but does its best to minimize any inconveniences.

Delivery

Deliveries are made during normal business hours to the address indicated by the user and in the manner specified in the order summary.

It is up to the user to check the conditions of the product that was delivered to them. It being understood that the risk of loss or damage to the products, for reasons not attributable to Hoop Sportswear, is transferred to the user when the user, or a third party designated by the same and different from the carrier, materially comes into possession of the product. The user is advised to check the number of products received and that the packaging is intact, not damaged, wet or otherwise altered and is invited, in his interest, to indicate on the transport document of the carrier, any anomalies, accepting the package with reserve. The unreserved receipt of the products, in fact, does not allow the user to take legal action against the courier, in the event of loss or damage to the products, except in the event that the loss or damage is due to willful misconduct or gross negligence of the courier itself and with the exception of partial loss or damage not recognizable at the time of delivery, provided that in the latter case, the damage is reported as soon as known and no later than 10 (ten) days after receipt. In the event that the package shows obvious signs of tampering or alteration, the user is also recommended to promptly notify the Hoop Sportswear customer service.

In any case, the application of the rules on the right of withdrawal and the legal guarantee of conformity remains valid.

In case of failure to collect within the deadline set by the carrier, the products will be returned to Hoop Sportswear, which will refund the price of the products including shipping costs.

Hoop Sportswear cannot be held responsible for errors in delivery due to inaccuracies or incompleteness in the compilation of the purchase order by the user, for any damage that may have occurred to the products after delivery to the carrier, where the latter has been chosen and appointed by the user or for delays in delivery attributable to the latter.

Right of withdrawal

In case of purchase of products from Hoop Sportswear, the consumer has the right to withdraw from the contract without indicating the reasons, within 14 days. The withdrawal period expires after 14 days from the day on which the consumer or a third party – other than the carrier and designated by the user – acquires physical possession of the goods.

The user is required to inform Hoop Sportswear of the decision to withdraw by means of an explicit declaration sent to the contacts listed in these terms and before the expiration of the withdrawal period.

Since the burden of proof relating to the exercise of the right of withdrawal before the expiry of the withdrawal period is borne by the consumer, it is in the interest of the consumer to keep a copy of the e-mail sent to Hoop Sportswear with the declaration of withdrawal.

To this purpose, to exercise the right of withdrawal, you can use the following sample withdrawal form:

• I/we hereby notify the withdrawal from my/our sales contract of the following goods/services:

The user is also free to express their choice to withdraw from the contract in any other equivalent form.

Effects of withdrawal

If you withdraw from this agreement, you will be refunded all payments you made in favor of Hoop Sportswear including delivery costs (except for the additional costs arising from the possible choice of a type of delivery cost delivery standard offered) without undue delay and in any event no more than 14 days from the day hoop sportswear is informed of the user’s decision to withdraw from this agreement. These refunds will be made using the same means of payment used by the user for the initial transaction, unless the user has expressly agreed otherwise.

Refund may be suspended until receipt of the goods or until the user’s demonstration that the goods have been sent.

The user is invited to return the goods and deliver them to Hoop Sportswear without undue delay and in any case within 14 days from the day on which you communicated the withdrawal from this agreement. The term is respected if the user sends the goods before the expiration of the period of 14 days.

The direct costs of returning the goods will be borne by the user.

Limitations on the right of withdrawal

Returned products which are damaged or used in a different way and further than is strictly necessary to establish the nature, the characteristics and the functioning will be refunded after deduction of the decrease in value resulting from the damage. Refund is excluded when the decrease in value is total.

The user is invited to insert a copy of the received delivery document inside the package.

The right of withdrawal is in any case excluded in relation to:

• The goods custom made or clearly customized (clearly customized means those goods which are made in a unique way for the customer, with names, logos etc, so as to make it impossible to re-use the product by the seller);
• The supply of goods which risk to deteriorate or expiry quickly;
• The supply of sealed goods that cannot be returned for hygienic or health protection reasons and have been open after delivery.

Guarantee of conformity

All products sold on Hoop Sportswear are covered by the legal warranty of conformity.

The user who purchases as a consumer has the right of legal guarantee on the compliance of the products and services purchased within the limit of 24 (twenty four) months of purchase.

To exercise the right of warranty, the user is required to contact the holder through the contact information contained in this document, giving an accurate description of the defect found, within two months from discovery of the defect.

If the defect of conformity of the product is verified, the user has the right to obtain, at his choice, repair or replacement of the product, as well as any expenses incurred for the return of the goods if the non-conformity was confirmed.

The user also has the right to request a reduction in the price or termination of the contract from Hoop Sportswear in the following cases:

• If the repair and replacement are impossible or excessively onerous;
• If Hoop Sportswear has not repaired or replaced the good within an adequate term, however not less than 15 (fifteen) days;
• If the replacement or repair previously carried out has caused significant inconveniences to the user.

The user is anyway obliged to return the defective products.

Spedizioni & Resi

Spedizione

La spedizione sul territorio nazionale ha un costo di €7 (sette) per gli acquisti inferiori a €80 (ottanta), è gratis per acquisti a partire da €80.

La spedizione fuori dal territorio nazionale ha un costo variabile a seconda della destinazione.

Le informazioni sulla spedizione vengono riepilogate in fase di acquisto e nell’e-mail di conferma dell’ordine.

Le consegne verranno effettuate da:
BRT per tutto il territorio nazionale ed europeo, con tempi variabili a seconda delle destinazioni. Si precisa che I tempi di consegna sono solo indicativi e vengono calcolati dal giorno di spedizione.

Hoop Sportswear non si assume la responsabilità per ritardi di sdoganamento, ma si impegna a ridurre al minimo eventuali inconvenienti.

Consegna

Le consegne vengono effettuate durante I normali orari lavorativi all’indirizzo indicato dall’utente e secondo le modalità specificate nel riepilogo dell’ordine.

Spetta all’utente verificare le condizioni del prodotto che gli è stato consegnato. Fermo restando che il rischio di perdita o danneggiamento dei prodotti, per causa non imputabile a Hoop Sportswear è trasferito all’utente quando l’utente, o un terzo dallo stesso designato e diverso dal vettore, entra materialmente in possesso del prodotto. Si raccomanda all’utente di verificare il numero di prodotti ricevuti e che l’imballo risulti integro, non danneggiato, né bagnato o comunque alterato, anche nei materiali di chiusura e lo si invita, nel suo interesse, a indicare sul documento di trasporto del vettore, eventuali anomalie, accettando il pacco con riserva. Il ricevimento senza riserve dei prodotti, infatti, non consente all’utente di agire in giudizio nei confronti del corriere, nel caso di perdita o danneggiamento dei prodotti, tranne nel caso in cui la perdita o il danneggiamento siano dovuti a dolo o colpa grave del corriere stesso e fatta eccezione per la perdita parziale o il danneggiamento non riconoscibili al momento della consegna, purché in quest’ultimo caso, il danno sia denunciato appena conosciuto e non oltre 10 (dieci) giorni dopo il ricevimento. Nel caso in cui la confezione presenti evidenti segni di manomissione o alterazione, si raccomanda inoltre all’utente di darne pronta comunicazione al servizio clienti di Hoop Sportswear.

Resta ferma, in ogni caso, l’applicazione delle norme in materia di diritto di recesso e di garanzia legale di conformità.

In caso di mancato ritiro entro il termine stabilito dal vettore, I prodotti verranno restituiti a Hoop Sportswear, che rimborserà il prezzo dei prodotti comprensivo dei costi di spedizione.

Hoop Sportswear non può essere ritenuta responsabile per errori nella consegna dovuti a inesattezze o incompletezze nella compilazione dell’ordine d’acquisto da parte dell’utente, per danni eventualmente occorsi ai prodotti successivamente alla consegna al vettore, ove quest’ultimo sia stato scelto ed incaricato dall’utente o per ritardi nella consegna a quest’ultimo imputabili.

Diritto di recesso

In caso di acquisto di prodotti su Hoop Sportswear il consumatore ha il diritto di recedere dal contratto senza indicarne le ragioni, entro 14 giorni. Il periodo di recesso scade dopo 14 giorni dal giorno in cui il consumatore o un terzo – diverso dal vettore e designato dall’utente – acquisisce il possesso fisico dei beni.

L’utente è tenuto a informare Hoop Sportswear della decisione di recedere tramite una dichiarazione esplicita inviata ai contatti riportati in questi termini e prima della scadenza del periodo di recesso.

Poiché l’onere della prova relativa all’esercizio del diritto di recesso prima della scadenza del periodo di recesso è a carico del consumatore, è nell’interesse dello stesso conservare copia della e-mail inviata a Hoop Sportswear con la dichiarazione del recesso.

A tal fine, per l’esercizio del diritto di recesso, può utilizzare la forma di seguito riportata:

• Con la presente io/noi notifichiamo il recesso dal mio/nostro contratto di vendita dei seguenti beni/servizi:
  (inserire qui una descrizione dei beni/servizi dal cui acquisto si intende recedere)

L’utente è peraltro libero di esprimere la propria scelta di recedere dal contratto in qualsiasi altra forma equivalente.

Effetti del recesso

Se l’utente recede dal presente contratto, gli saranno rimborsati tutti I pagamenti che ha effettuato a favore di Hoop Sportswear compresi I costi di consegna (ad eccezione dei costi supplementari derivanti dalla eventuale scelta di un tipo di consegna diverso dal tipo meno costoso di consegna standard offerto) senza indebito ritardo e in ogni caso non oltre 14 giorni dal giorno in cui Hoop Sportswear è informata della decisione dell’utente di recedere dal presente contratto. Detti rimborsi saranno effettuati utilizzando lo stesso mezzo di pagamento usato dall’utente per la transazione iniziale, salvo che l’utente non abbia espressamente convenuto altrimenti.

Il rimborso può essere sospeso fino al ricevimento dei beni oppure fino all’avvenuta dimostrazione da parte dell’utente di aver rispedito I beni, se precedente.

L’utente è pregato di rispedire I beni e di consegnarli a Hoop Sportswear senza indebiti ritardi e in ogni caso entro 14 giorni dal giorno in cui ha comunicato il recesso dal presente contratto. Il termine è rispettato se l’utente rispedisce I beni prima della scadenza del periodo di 14 giorni.

I costi diretti della restituzione dei beni saranno a carico dell’utente.

Limitazioni al diritto di recesso

I prodotti resi che risultino danneggiati od usati in modo diverso ed ulteriore rispetto a quanto strettamente necessario per stabilire la natura, le caratteristiche ed il funzionamento saranno rimborsati previa detrazione della diminuzione di valore conseguente al danneggiamento od utilizzo. Il rimborso è escluso quando la diminuzione di valore è totale.

L’utente è pregato di inserire all’interno del pacco una copia del documento di consegna ricevuto.

Il diritto di recesso, è in ogni caso escluso in relazione a:

• I beni confezionati su misura o chiaramente personalizzati (per chiaramente personalizzati si intendono quei beni che vengono realizzati in maniera unica per il cliente, con nomi, loghi etc, in modo tale da rendere impossibile il riutilizzo del prodotto da parte del venditore);
• La fornitura di beni che rischiano di deteriorarsi o scadere rapidamente;
• La fornitura di beni sigillati che non si prestano ad essere restituiti per motivi igienici o connessi alla protezione della salute e sono stati aperti dopo la consegna.

Garanzia legale di conformità

Tutti I prodotti venduti su Hoop Sportswear sono coperti dalla garanzia legale di conformità.

L’utente che acquista in qualità di consumatore ha il diritto di garanzia legale sulla conformità dei prodotti e servizi acquistati nei limiti di 24 (ventiquattro) mesi dall’acquisto.

Per esercitare il diritto di garanzia, l’utente è tenuto a contattare il titolare tramite le informazioni di contatto contenute nel presente documento, dando una descrizione accurata del vizio riscontrato, entro due mesi dalla scoperta del vizio.

Qualora fosse accertato il difetto di conformità del prodotto, l’utente ha il diritto di ottenere, a sua scelta, la riparazione o sostituzione del prodotto, nonché le eventuali spese sostenuto per il rinvio della merce qualora fosse accertata la non conformità.

L’utente ha inoltre il diritto di richiedere a Hoop Sportswear una congrua riduzione del prezzo o la risoluzione del contratto nei seguenti casi:

• • Qualora la riparazione e la sostituzione risultassero impossibili o eccessivamente onerose;
  • Qualora Hoop Sportswear non abbia provveduto alla riparazione o alla sostituzione del bene entro un termine congruo, comunque non inferiore a 15 (quindici) giorni;
  • Qualora la sostituzione o la riparazione precedentemente effettuata abbia arrecato notevoli inconvenienti all’utente.

L’utente è comunque tenuto a restituire I prodotti difettosi.
